VibeNest respects your privacy.

This Privacy Policy explains how VibeNest collects, uses, stores, shares and protects personal information when you visit vibenest.app, create or use a VibeNest profile, purchase VibeNest PRO, submit a report, contact us or otherwise use our services.

For data protection purposes, VibeNest is the controller of personal information described in this Privacy Policy unless otherwise stated.

1. Information we collect

The information we collect depends on how you interact with VibeNest.

Account information

When you create or use a VibeNest account, we may collect:

  • your email address;
  • username;
  • password in securely hashed form;
  • age-verification information;
  • account creation date;
  • account settings and preferences;
  • account status;
  • login and security information; and
  • information about your use of VibeNest.

We do not store your password in readable plaintext form.

Age information

We may ask for your date of birth in order to determine whether you meet VibeNest's age requirements and which age-related protections or restrictions apply.

Where possible, we do not retain your complete date of birth after the age check.

Instead, we may retain information necessary to apply age-related rules, such as:

  • confirmation that you meet the minimum age;
  • whether additional protections for users under 16 apply;
  • whether you are under 18; and
  • whether age-restricted features are available to your account.

We use this information for safety, legal compliance and to provide age-appropriate features.

2. Profile and Content information

When you create or customise a VibeNest profile, we may process information you choose to provide, including:

  • display name;
  • username;
  • biography;
  • avatar;
  • images;
  • backgrounds;
  • GIFs;
  • videos;
  • audio or music;
  • music links or embeds;
  • fonts;
  • custom cursors;
  • social links;
  • website URLs;
  • external account usernames;
  • buttons and links;
  • profile customisation settings; and
  • other Content you choose to publish.

Some of this information is intended to be public.

You should not publish information on your profile that you do not want other people to see.

3. Public profiles

VibeNest profiles are generally public.

Information that you choose to publish may be visible to:

  • anyone visiting your VibeNest URL;
  • other VibeNest users;
  • search engines;
  • automated indexing services; and
  • people accessing a copy or link shared by another person.

Public information may include your:

  • username;
  • display name;
  • profile image;
  • biography;
  • links;
  • social accounts;
  • media;
  • custom profile elements; and
  • other Content you deliberately publish.

Search engines such as Google or Bing may index public VibeNest profiles.

Even after information is removed from VibeNest, a search engine or third party may temporarily continue to display a cached or independently stored copy that VibeNest does not control.

4. Children and younger users

You must be at least 13 years old, or the higher minimum age required by applicable law, to use VibeNest.

Users aged 13–15 are subject to additional protections and restrictions.

These may include:

  • additional privacy protections;
  • limitations on certain features;
  • restrictions on adult or sensitive content;
  • parental or guardian permission requirements;
  • restrictions on purchases; and
  • other measures designed to provide an age-appropriate experience.

Users under 18 cannot use features restricted to adults.

We aim to collect no more information from younger users than is reasonably necessary to operate VibeNest safely and provide the requested Service.

If we discover that an account belongs to someone who is below the applicable minimum age, we may restrict or delete that account.

5. Technical and security information

When you access VibeNest, we and our infrastructure providers may automatically process technical information such as:

  • IP address;
  • request timestamps;
  • browser type;
  • device type;
  • operating system;
  • approximate geographic location;
  • referring website or source;
  • pages requested;
  • login events;
  • security events;
  • error information; and
  • other network or diagnostic information.

IP addresses

VibeNest may retain IP addresses in security, authentication and server logs where reasonably necessary to:

  • secure accounts;
  • detect suspicious logins;
  • prevent fraud;
  • investigate abuse;
  • enforce rate limits;
  • detect attacks; and
  • protect VibeNest infrastructure.

We do not intend to provide profile owners with the full IP addresses of people who visit their profiles.

Infrastructure, security and analytics providers may process an IP address as part of handling a network request even where VibeNest does not permanently retain that IP in profile analytics.

6. Approximate location

VibeNest does not collect precise GPS location as part of ordinary use of the Service.

We may determine an approximate location, such as country or region, from an IP address for purposes including:

  • security;
  • fraud prevention;
  • analytics;
  • localisation; and
  • understanding how VibeNest is used.

Approximate IP-based location is not intended to identify your exact physical address.

7. Profile analytics

VibeNest may collect analytics relating to public profiles.

This may include:

  • profile views;
  • link clicks;
  • approximate date and time;
  • approximate country;
  • browser or device category; and
  • referral source.

We may use this information to provide aggregate analytics to profile owners and to understand how VibeNest is used.

Profile owners may be shown information such as total clicks or other aggregated statistics.

VibeNest does not intend to expose an individual visitor's full IP address or direct identity to a profile owner through profile analytics.

Analytics may be filtered, aggregated or otherwise processed to reduce abuse and improve privacy.

8. Link clicks

When you click a link from a VibeNest profile, we may record information such as:

  • that the link was clicked;
  • which VibeNest profile contained the link;
  • the destination identifier or URL;
  • approximate date and time; and
  • related aggregate analytics information.

This information helps us provide profile analytics, protect the Service and measure feature performance.

After following an external link, the destination website's own privacy policy applies.

9. Cookies and similar technologies

VibeNest uses cookies and similar technologies where necessary to operate the Service.

These may include technologies used for:

  • authentication and login sessions;
  • account security;
  • remembering preferences;
  • theme or interface settings; and
  • other essential functionality.

We also use analytics services, including services described in this Privacy Policy.

Where applicable law requires consent before using a non-essential cookie or similar technology, we will request that consent before using it.

10. Google Analytics

VibeNest may use Google Analytics to understand general use of the website and improve the Service.

Depending on configuration and your consent choices, Google Analytics may process information such as:

  • pages visited;
  • approximate location;
  • device and browser information;
  • referral source;
  • interaction information; and
  • technical identifiers.

Where consent is legally required for Google Analytics or associated technologies, we will use them only in accordance with that requirement.

Google acts as an independent provider or processor as applicable to the relevant service and configuration.

11. Cloudflare

VibeNest uses Cloudflare for infrastructure and security services that may include:

  • DNS;
  • content delivery and caching;
  • protection against malicious traffic and DDoS attacks;
  • network security;
  • analytics; and
  • Cloudflare Turnstile.

Cloudflare may process technical information including IP addresses, request information, security signals, browser information and network identifiers when you access VibeNest.

Cloudflare Turnstile

We may use Cloudflare Turnstile to distinguish genuine users from automated or abusive activity.

Turnstile may process browser, device, network and interaction signals for security purposes.

We use this functionality to protect accounts, prevent spam and reduce automated abuse.

12. VibeNest analytics

In addition to third-party analytics providers, we may operate our own analytics systems.

These systems may process information such as:

  • page and profile views;
  • link clicks;
  • feature usage;
  • approximate geographic information;
  • referrals;
  • device categories; and
  • aggregate activity.

We use internal analytics to:

  • provide analytics features;
  • improve VibeNest;
  • understand feature performance;
  • identify technical issues;
  • prevent abuse; and
  • make product decisions.

13. Payments and VibeNest PRO

Payments for VibeNest PRO are processed by Stripe.

When you purchase PRO, Stripe may collect information such as:

  • your payment-card details;
  • billing information;
  • payment method;
  • payment authentication information; and
  • transaction information.

VibeNest does not normally receive or store your complete payment-card number.

We may receive and retain information from Stripe such as:

  • payment or transaction ID;
  • payment status;
  • amount;
  • currency;
  • date of payment;
  • product purchased; and
  • information necessary to associate the purchase with your account.

We use this information to:

  • provide PRO;
  • confirm payments;
  • prevent fraud;
  • handle refunds or disputes;
  • maintain transaction records; and
  • comply with accounting, tax and legal obligations.

Stripe processes payment information under its own privacy practices in addition to any processing it performs on our behalf.

14. Email communications

We may use your email address to send:

  • account-related messages;
  • password reset messages;
  • login or security notifications;
  • moderation or enforcement notices;
  • important changes to VibeNest;
  • changes to our Terms or policies;
  • purchase-related communications; and
  • other essential service communications.

These messages are part of operating your VibeNest account and may not always be optional while you maintain an account.

Marketing

We may send promotional or marketing emails only where we have an appropriate legal basis to do so.

Where consent is required, marketing will be opt-in.

You may withdraw consent or unsubscribe from marketing communications at any time.

Unsubscribing from marketing does not prevent us from sending essential account, security, legal or transactional messages.

15. Error monitoring and logs

We maintain server, application and security logs to operate and protect VibeNest.

Information contained in these systems may include:

  • error messages;
  • timestamps;
  • request information;
  • device or browser information;
  • technical identifiers;
  • IP addresses where necessary;
  • diagnostic information; and
  • information necessary to investigate technical or security problems.

We use this information to maintain reliability, troubleshoot problems and protect VibeNest.

16. Hosting and infrastructure

VibeNest uses Cloudflare and additional infrastructure providers to deliver and operate the Service.

These providers may process personal information on our behalf where necessary to host, store, transmit, secure or back up the Service.

17. Reports and safety information

If you submit a Report Violation or contact us about harmful or unlawful activity, we may collect:

  • your email address, if provided;
  • the reported account or profile;
  • report category;
  • description;
  • supporting evidence;
  • screenshots or links;
  • date and time;
  • communications relating to the report; and
  • information generated during our investigation.

We may allow certain reports to be submitted without providing contact information.

We use report information to:

  • investigate violations;
  • protect users;
  • enforce our Terms and Community Standards;
  • prevent fraud or abuse;
  • respond to legal complaints;
  • protect rights and safety; and
  • comply with legal obligations.

We generally do not tell a reported user the identity of the person who submitted a report unless disclosure is required by law or necessary in connection with a legal process.

18. How we use personal information

We may use personal information to:

  • create and maintain accounts;
  • provide public VibeNest profiles;
  • authenticate users;
  • provide customisation features;
  • host user Content;
  • provide analytics;
  • process PRO purchases;
  • communicate with users;
  • verify age eligibility;
  • apply age-related restrictions;
  • provide customer support;
  • detect fraud;
  • prevent spam and abuse;
  • secure accounts and infrastructure;
  • investigate Community Standards violations;
  • process intellectual-property complaints;
  • comply with legal obligations;
  • enforce our Terms;
  • improve VibeNest;
  • troubleshoot technical issues; and
  • protect users, VibeNest and third parties.

19. Our legal bases for processing

Where UK GDPR, EU GDPR or similar legislation requires a legal basis, we rely on one or more of the following.

Contract

We process information where necessary to provide the Service you requested or take steps at your request before entering into a contract.

Examples include:

  • creating your account;
  • hosting your profile;
  • saving your profile settings;
  • providing VibeNest features;
  • processing PRO purchases; and
  • providing account support.

Legitimate interests

We may process information where reasonably necessary for legitimate interests pursued by VibeNest or others, provided those interests are not overridden by your rights.

These interests may include:

  • securing the Service;
  • preventing fraud and abuse;
  • protecting accounts;
  • providing and improving analytics;
  • troubleshooting errors;
  • understanding use of VibeNest;
  • protecting legal rights;
  • enforcing our Terms; and
  • improving the Service.

Where children are involved, their rights and best interests receive particular consideration.

Consent

We rely on consent where legally required, including for certain:

  • marketing communications;
  • non-essential cookies;
  • analytics technologies; or
  • optional processing activities.

Where processing is based on consent, you may withdraw that consent.

Legal obligations

We may process information where necessary to comply with laws, regulations, court orders, lawful requests or legal obligations.

This can include financial records, regulatory compliance and certain safety or law-enforcement matters.

Vital interests and other lawful grounds

In exceptional situations, we may process or disclose information where reasonably necessary to protect someone's life, physical safety or other vital interests, where permitted by law.

20. When we share information

We do not sell personal information.

We may share information with service providers where reasonably necessary to operate VibeNest.

These may include providers of:

  • hosting and databases;
  • CDN and network infrastructure;
  • security and anti-abuse services;
  • email delivery;
  • analytics;
  • payment processing;
  • error monitoring;
  • storage and backups; and
  • technical infrastructure.

These providers may process personal information only as permitted by their contracts, applicable laws and their respective roles.

Legal and safety disclosures

We may disclose information where reasonably necessary to:

  • comply with applicable law;
  • respond to a valid court order or legally binding request;
  • investigate illegal activity;
  • protect someone's safety;
  • prevent fraud or cyberattacks;
  • establish, exercise or defend legal claims; or
  • protect the rights and security of VibeNest and its users.

We do not voluntarily disclose user information to authorities merely because someone asks for it. Requests must have an appropriate legal basis.

21. Business changes

If VibeNest is involved in a merger, acquisition, financing, restructuring, sale or transfer of some or all of the Service, personal information may be disclosed or transferred as part of that transaction where permitted by law.

Any successor responsible for that information will remain subject to applicable data protection obligations.

22. International data transfers

VibeNest is available globally, and our service providers may process information in countries other than the country where you live.

Where personal information is transferred internationally, we take steps required by applicable data protection law.

Depending on the circumstances, these may include:

  • recognised adequacy regulations or decisions;
  • approved standard contractual protections;
  • the UK International Data Transfer Agreement;
  • the UK International Data Transfer Addendum;
  • other approved safeguards; or
  • a legally recognised exception where applicable.

We aim to ensure that international transfers provide an appropriate level of protection for personal information.

23. How long we keep information

We keep personal information only for as long as reasonably necessary for the purpose for which it was collected, including legal, accounting, security and dispute-resolution requirements.

Different categories of data have different retention periods.

Active accounts

Information required to operate an account may normally be retained while the account remains active.

Security and technical logs

Routine security logs may generally be retained for up to 90 days.

Information may be retained for longer where reasonably necessary to investigate:

  • security incidents;
  • fraud;
  • abuse;
  • attacks;
  • legal disputes; or
  • serious Terms or Community Standards violations.

Payment records

Transaction and accounting information may be retained for the period required by applicable tax, accounting and financial laws.

Reports and enforcement records

Reports, moderation decisions and related evidence may be retained for as long as reasonably necessary for:

  • safety;
  • appeals;
  • repeat-abuse detection;
  • legal compliance;
  • dispute resolution; or
  • enforcement of our policies.

Banned accounts

If an account is permanently banned, we may retain a limited amount of information where necessary to prevent ban evasion, fraud or repeated serious abuse.

This may include information such as:

  • internal account identifiers;
  • hashed or otherwise minimised identifiers;
  • relevant security records;
  • enforcement history; and
  • other limited information reasonably necessary to enforce the ban.

We do not retain more information for this purpose than is reasonably necessary.

24. Account deletion

You can request deletion of your account through the available account settings.

When deletion is requested:

  1. your public VibeNest profile becomes unavailable;
  2. your username is temporarily reserved;
  3. the account enters a 7-day deletion period;
  4. during those seven days, you may cancel deletion and recover your account; and
  5. once the seven-day period expires, deletion becomes permanent.

We then remove the account and associated user Content from our active systems, subject to the limited exceptions described below.

After deletion becomes permanent, the username may become available for another person to register.

25. Backups after deletion

Deletion from active systems does not necessarily mean every technical backup disappears at exactly the same moment.

Encrypted or restricted backups may temporarily contain previously deleted information until the relevant backup is automatically rotated, overwritten or expires.

Such backups are not intended to be restored into active use except where necessary for legitimate disaster recovery or security purposes.

If a backup containing deleted information is restored, we will take reasonable steps to ensure the deletion request continues to be respected.

We may also retain limited information where necessary to comply with law, maintain financial records, prevent serious abuse or establish or defend legal claims.

26. Your privacy rights

Depending on where you live and the law that applies to you, you may have rights concerning your personal information.

These may include the right to:

  • request access to your personal information;
  • obtain a copy of your information;
  • correct inaccurate information;
  • request deletion;
  • restrict certain processing;
  • object to certain processing;
  • receive certain information in a portable format;
  • withdraw consent;
  • object to direct marketing; and
  • lodge a complaint with a data protection regulator.

Some rights are subject to legal conditions and exceptions.

We may need to verify your identity before fulfilling a request in order to prevent unauthorised access to another person's information.

27. UK privacy rights and the ICO

If you are in the United Kingdom, you may have rights under UK data protection law.

You also have the right to complain to the Information Commissioner's Office (ICO), the UK's data protection regulator.

Nothing in this Privacy Policy limits your right to contact the ICO.

28. EEA and other jurisdictions

If you live in the European Economic Area or another jurisdiction that provides additional privacy rights, you may also have the right to contact the competent data protection authority in the place where you live, work or where an alleged infringement occurred.

VibeNest will respect mandatory privacy rights that apply to users based on their jurisdiction.

29. Automated decision-making

VibeNest does not currently use personal information to make solely automated decisions that produce legal or similarly significant effects on users.

We may use automated tools for ordinary technical or security purposes, such as:

  • detecting bots;
  • identifying suspicious traffic;
  • spam prevention;
  • rate limiting; and
  • flagging potentially abusive behaviour for review.

These systems are intended to protect the Service and are not intended to constitute significant automated decision-making where prohibited or regulated by applicable law.

30. Artificial intelligence

VibeNest does not use your private account data or user Content to train VibeNest artificial-intelligence models.

If this practice materially changes in the future, we will update this Privacy Policy and, where required, request appropriate consent before beginning such processing.

31. Advertising

VibeNest does not currently display third-party advertising as part of the Service.

We may introduce advertising or promotional features in the future.

If doing so changes how personal information is used, introduces advertising cookies or involves new data-sharing practices, we will update this Privacy Policy and obtain consent where required by law.

We do not sell personal information to advertisers.

32. Data security

We use reasonable technical and organisational measures designed to protect personal information.

These may include:

  • password hashing;
  • encrypted connections;
  • access controls;
  • network security;
  • anti-abuse protections;
  • Cloudflare security services;
  • rate limiting;
  • monitoring;
  • restricted administrative access; and
  • other security practices appropriate to the Service.

However, no website, network, database or method of electronic storage can be guaranteed to be completely secure.

You are responsible for keeping your account credentials confidential and using reasonable precautions to protect your account.

33. Data minimisation

We aim to collect only information that is reasonably necessary to provide, secure and improve VibeNest.

Where information is no longer necessary, we aim to delete, anonymise or otherwise minimise it unless retention is required for a legitimate legal, safety or operational reason.

This is particularly important when processing information relating to younger users.

34. Third-party websites and services

VibeNest profiles may contain links, embeds or integrations involving third-party services.

When you interact with those services, they may collect information independently from VibeNest.

Their processing is governed by their own privacy policies.

VibeNest is not responsible for the privacy practices of an external website merely because a user has linked to it from a VibeNest profile.

35. Social links

If you add a social-media profile, website or external account to VibeNest, we generally store the URL, username or other information that you deliberately provide.

Unless expressly stated for a particular integration, VibeNest does not automatically obtain private account information from the linked social platform.

36. Changes to this Privacy Policy

We may update this Privacy Policy as VibeNest changes, our service providers change or applicable laws and regulatory requirements evolve.

The current version will display its effective date and last-updated date.

If we make a material change, we may provide additional notice through:

  • the VibeNest website;
  • your account;
  • email; or
  • another appropriate method.

Where a change requires consent under applicable law, we will request consent rather than relying solely on an updated Privacy Policy.
